Gay man claims he was arrested for ‘being gay’

A gay man visiting friends in Columbia, Tennessee claims he was harassed and arrested by Maury County Sheriff deputies and Columbia Police officers because he was “gay and effeminate.”

Brian Williams (not his real last name but he asked that it be changed for fear of retalitation), 39, of San Francisco, CA, was visiting Mathew Sabah, 27, and other friends in Columbia, when he was arrested on March 24 for public intoxication – despite his claims that he had drunk no alcohol and no sobriety tests were performed on him for public intoxication.

After spending four hours in the Maury County Jail, Williams was released without any charges against him.

“I was not issued a citation,” Williams said. “To me this is outrageous and just as clear and unjust a hate-based case of anti-gay discrimination.”

Williams said he was given a bail receipt which indicated he has a court date of May 1 at 1:30 p.m.

"I believe there were charges of public intoxication, but I wasn't issued a summons or citation," he said.

For Williams and Sabah, the evening on Saturday, March 24 started out innocently enough. The two, along with another friend and Sabah’s sister, went to the Sports Page, 300 East James Campbell Blvd., in Columbia.

“We were uncomfortable about going in this bar anyway, but my sister had been there on many occasions, and assured us that the people who also went there, were a nice group,” Sabah explained. “However as soon as we walked in together, heads were starting to turn and looking our way. They stared us down, and I felt very uncomfortable from the get go.

But my sister assured us all was fine, and she left us to socialize.”

Sabah said drinks were ordered and it was decided that Williams – who would soon face the public intoxication charge – would be the group’s designated driver.

“Brian drank coke,” Sabah added. “We were there about an hour and half and then it all started.  About ten police officers came in. Some went to one side of the bar and stood watching us. Two - a male and female officer stood near us - one on one side of our table, and the other on the other side of our table.”

Sabah said the officers stood close to them for “roughly 20 or 30 minutes.” During that time, he said he, Brian Williams and another friend continued to talk and socialize.

“We three men were quiet, not loud, and not offensive,” he said. “We were causing no trouble. The two officers stood by our table and listened to us chat, and I do believe they were called to have us removed from the Sports Page, and was trying to find any excuse to remove us from the establishment. The bartender and hostess had already shunned us. Finally one of the officers leaned over the middle of our table and said, ‘you three need to leave.’ When we asked why, he said, ‘you’re publicly intoxicated."

It’s a charge that Williams vehemently denies.

“We were not, especially I,” Williams said. “One of my friends had about two thirds of a drink the other had about half. I had not had any alcohol. Meanwhile, going right past this officer, is a girl that is so drunk she can't even walk. She was being carried by her friends, people stumbling, screaming, yelling, and very obviously drunk.”

Williams said the group was singled out because they are all gay.

“The officer had stood next to us long enough to listen to our conversation and from that easily could ascertain that we were a group of gay men, not to mention we were rather well dressed compared to the general customer base and kind of stuck out visually as well,” he said. “I called this officer on his homophobia, and asked if he had ever heard of the ACLU. I was a little upset about being singled out. I then walked to the car and waited for the others.”

Williams said before his friends could make it to the car, he was in handcuffs and was being arrested for public intoxication.

“I was angry and in a state of shock,” he said. “I couldn't believe they would take their homophobia to this level. I was taken without a sobriety test to the Maury County Jail where once again no alcohol level test was conducted; I was simply placed in a cell without telephone access or toilet facilities and held for four hours until my friends were allowed to bail me out. I was told at the jail that everything was done and that there was no need to go to court.”

Williams admits that none of the officers made direct comments about his or his friend’s sexuality.

“No, not directly,” he said when asked if any of the officers made comments about his sexual orientation.

He said he plans on contacting the District Attorney to “voice my opinion to them and also try and get them to drop the case.”

He said Mathew Sabah did contact the DA’s office and that “Matthew tried to speak to the DA, and the DA was unresponsive.”

Matthew Sabah said that he did call the local District Attorney’s office.

“I called them and they stated each case is different and they would not be interested in taking the complaint until they looked at the issue further,” Sabah said.

“The police report is good fiction,” he added. To me this is outrageous and just as clear and unjust a hate-based case of anti-gay discrimination as any other. Being from Northern Colorado originally and having been acquainted with numerous friends of Matthew Shephard, I was literally fearful in that jail, I am now having nightmares and am afraid to be in groups of people. This has left a scar on me that you can't see, but I can certainly feel.”

I am outraged with the hate in this county. I live off Hatcher Ln and I walk everywhere I go cause I don't have a car. I get looked upon like a sore thumb. I think that the sheriff and police dept. in Maury County are the worst I have ever seen. I am originally from Columbus, Ohio where gays were treated fairly well. I wish that this man is cleared of all "wrong" doing. He did nothing wrong!

To the person who wrote appaled, first off i would wonder why if your such a christian god loving bible toting person what on earth would you be doing reading this paper. Second yes my friend was sober and no we were not flaunting at all I think anyone who knows these small towns would do no such thing. and third people like you are the reason why the world is such a mess, you directly contribute to hate and violence. What if we have you removed the Walmart for being a christian?? I think religion is one of the worst things society ever invented to try and control people.. There is more hate and crime that come from this than anything else, read and educate yourself on something more than the bible and open your eyes becasue you are going straight to where it will be warm for your hate.

We live openly lesbian only 2 miles from the Maury county line, in Williamson County. Everyone asks why we don't live in Maury county where it is cheaper. One reason is the schools, but honestly the main reason is we live close enough but far enough away that we are safe. We have children to protect and we run a column that requires us to be open and loud and proud because we are usually filming or writing or interviewing or doing something that would "out" us. So it is easier for us to be out in Williamson county than in Maury County. We do go into Columbia allot, and we have friends that live in Columbia, but we could never live there knowing that the very people that are supposed to be there to protect and serve you, are wishing you harm all the while.Hersband and WifeThe whimsical lesbian advice columnists.

I was reading the comments and can't help but wonder; why was 'Appalled' even on this website to begin with? I think both gay and straight people would agree that taking a drunk driver off the road is the right thing to do. Which is why they had a designated driver. As far as not liking "gays" in public, give me just a small break! I would bet money they we not flaunting being gay in a place such as the Sports Page. I'm not starting a debate on, what if they were or not. All I'm saying is they were picked on because they were different from the usual suspects.

Reading this article makes me so mad! I am tired of you gay people saying the south is known for this or that we are all red necks! I am a white Christian and I do believe it is wrong for gays to be in any establishment flaunting it. If you don't like it down here so much then mapquest the quickest way out of town. We have high moral values and we believe in the lord. I don't believe that 10 police officers were there soley to pick on you guys. I thang God that we still have some moral values somewhere in this world!Are we really supposed to believe that non of them were drunk? People do not get arrested for the way they are dressed.I support the police and the bar for taking these drunk drivers off our roads.

My partner and i moved here a few years ago, and i do find Columbia to be the steriotypical Homophobic southeren town, although they may be nice to your face, behind your back they are not the Christians they pretend to be! We expereinced the police harrassing in the park during a lunch date/ sitting at a table with our lunch talking, having them pull up facing us with the whole rest of the park to park and survey the area, they choose to park 15 feet from us and just glare.I wanted to lean over a kiss my partner , but i knew i would be in jail in a second, but it would have been worth the look on the officers face!!! It's a public park, it's not like were having sex on the fricken table! I was hoping they would say something, although i would have gone to jail for some reason i'm sure! In numbers we do have more voice, and i agree, as to NOT support those establishments. My girlfriend and I live in Columbia. In the week preceding the November elections, she heard several police officers (not sure if they were county or city) in a local dentist office discussing ammendment 1. They were very much in support of the ammendment (which means they were against gay marriage). Their comments led her to believe that they had issues with gay people in general. Knowing this information totally makes Brian's story even more believable to me. I disagree with anyone who thinks boycotting Columbia and the Sports Page is the answer. If change is going to occur, it must occur from within. Segregating ourselves from straight people does nothing but alienate us even more and promotes a misunderstanding as to who we are. Only the weak would choose to run from injustice. My girlfriend and I are appealing a judgement in which she lost custody of her kids. Care to take a guess why she lost them?? Stand your ground, Brian!! We need more brave souls like you here in Mule Town!!

Of course this crap is still going on down there!We have so many other things to worry about other than whether or not a "gay" person is drinking in a homophobic astablishment. Apparantly Columbia is so crime free that not 1 but 10 officers had nothing better to do than come to a bar and stop three men from having a good time. It's 2007,time for Columbia and anywhere else that is behind in the times to realize not everyone out there is a white, Christian, NRA card holder! Remember Brian, Matthew and anyone else that was harrassed that evening, not everyone thinks like them. There are plenty of people out there that know how wrong it is. Make your mark, don't let them consume your life!( A snake will never grow wings)

Brian, I applaud you for speaking out and fighting back. This kind of think goes on everywhere and we need to stop it. I had two friends who ran into similar trouble in Boston: they were arresting for "streetwalking" while walking down the sidewalk in a gay area of town. They had to return from out-of-state to make court appearances but the cops never showed, so the judge finally dismissed the case. I tried to get them to fight but they were afraid - of losing their jobs, of more abuse, etc. Only by speaking out can we fight this. Thanks for doing your part! Billy

This wasn't about someone calling me a name, this was about a sheriff deputy/s with a homophobic atitude that thought they could intimidate me, and they did, arresting me on false pretenses for simply being who I am I agree with your live and let live ideal, but this wasn't a matter of being called a f@g or q&@@r, this was the police using their authority to discriminate against me. SO thank you for your support but I will not go quietly into the night and take this charge and subsequent criminal record, it is unjust and I must fight it, if only all the other people that have had this kind of thing happen to them would stand up and let their voices be heard instead of letting the fear hush them. Until we all stand together, and all make out voices heard this kind of thing will continue, this is only one small battle against homophobia. It won't do much I am sure in the long run in this fight, but each victory that is won in this fight is a small step towards equality under the law, and possibly a small step towards ending this predjudice. Because it happens all the time does not make it okay. Because people are fearful and don't speak up, does not make its effect less scarring, it just serve to anger people like myself to speak out loud and proud about who they are and what they are, and it makes me angry and I want to bring this into the light of the general public. Live and let live, but don't arrest people because they are different than you!

i am very sorry you have to go through this, but there is something i would like to point out, several of the commenters have done just as bad as the police officers, in the fact of calling them rednecks, thats a slang in itself and should not be posted to any of your comments, slamming them is just as bad as what they did to you, with that said the south and the west have some very diffrent issues on there way of being, its sad you had to live it first hand, the fact of the story is there is always going to be discrimanation against the person who decides to walk a diffrent path... its not fair no and i'm sorry you are so scarred after this it was proably pretty scary...we just need to live and let live, if we disagree with someone elses way of life keep it to ourselves and go on... this is only my opion....

Sadness and anger does not even begin to describe what I feel about this incident. Brian W happens to be a dear close friend of mine and to have something like this happen to him is nothing short of outrageous!! The burning question in my mind is when is it ever gonna stop? When will we ever find an end to such discrimination in this country? I think people should stop cowering in fear and start standing up against gay discrimination no matter where you live in this country.

It is VERY clear that Brian was a victim of gay dicrimination and it makes me sick to my stomach that this incident occurred - in this day and age. I don't know what these redneck cops think they can get away with, but they're not going to get away with this!!! I urge all of you to stand by Brian, offer your help, get the news out there and help him with his case with the ACLU. Don't turn a blind eye to this and think that you can't do anything abut it. You can make a difference!!By the way, it won't help to hassle the police department in Columbia, TN., you will just cause more trouble in this case. Let's just hope the ACLU will weed out these pariah and that ALL of their officers involved are properly punished for THEIR hate crime! I was very sad and angry when this happened to Brian. I am the sister who invited them out to the Sports Page I thought we would be able to have a good time like everyone else because I have never had a problem there myself..but It was very clear that night what the arresting officer (M. Johns) problem truly was, and it was that he was homophobic. When bikers were pulling up at the bar as we were leaving bragging to the officers (buddies of theirs I am assuming) about the 5 beers they just drank at a place down the road to they didn't get arrested that just proves the point all the more. This in my opinion is very discriminating and unjust. People need to realize that this is 2007, whether we are gay, straight, white, black, asian, mexican etc. We are all people we have the right to be who we want to be and do what we want to do. There is nothing illegal about being gay..is there? I thought we had freedom in this Country but I am seeing that isn't the case. I think all these small town folks need to make a trip to the big cities so they can realize the world has changed since the 1930's..I will stand by my brother, Brian and all of my gay friends no matter what, and this is an issue we will conquer!!

I am apalled at how often things like this happen in this day and age. Whenever you guys get ready to go for that "sit in" in that establishment, just let me know and I will make it my business to be there to sit with you and support you. I am friends with one of the men's sisters and I have told her that we need to do something of the sort. Although I am a straight female, raised in GA, this subject is close to my heart, as one of my most dear friends on earth was murdered, due in large part to his sexual orientation. What makes this story send a chill down my spine is his name was Brian as well. He was a wonderful person and I miss him so much. He was stabbed in his front yard and staggered to his porch before he collapsed and bled to death. No one was ever charged with this crime! I will always believe that it was because he was gay and everyone knew it. My heart goes out to these men who did nothing wrong and did not deserve such treatment.

My partner and I live about 10 miles from the place at the edge of Columbia. We moved here about two years ago from Atlanta, and we don't go to any of the bars in town because we feared something like this could happen. I cannot even put into words how absolutely sad and deplorable that I find this situation. I guess I hoped that we were just being paranoid, and as we got to know more people, we would be more comfortable going out locally.We have met some wonderful people while doing business in Columbia, but we would never go out for a drink here in town. Now, I am glad we made the trips to Nashville instead. My instant impulse is revenge by numbers. They couldn't throw out or pick on 50 gays and supporters attending the bar, but that would only cause more hostility. It feels good to think of doing it.

I am sorry to hear of this outrageous incident. It's hard to believe that this has happened in an area that I practically grew up in. Actually, my partner and I live in a town smaller than Columbia just a few minutes away from there. We both work in our small town and have jobs where we are seen by people in the community daily. Each and every day we deal with the public in some way...some of them nice and some of them not so nice. At times we get "looks" because we are dressed in our slacks and button down shirts instead of the flannel and work boots most of the men in this town wear. For the most part, we are very welcomed and accepted by co-workers and a few close friends in our small, country, backwoods, "redneck" town. We have been invited to "hang out" at the same bar and we opted out of it. Small town bars such as the Sports Page look to be seedy and it seems that bars or pubs in these towns, in my opinion, would not be very "gay" friendly. I hope Brian finds justice in all of this and we support him all the way!!

Welcome to the Good Ole Boy network! It is appalling that in this day and age that this kind of discrimination is still going on. My god,do we ask red necks to leave a bar because they are red necks? I happen to know the parties involved and it saddens me to think I have to worry about whether or not he is safe just because he lives in a small town in the south. Columbia was barley on the map prior to this and now I can see why. Keep your heads up and eyes open guys...

This is outrageous and unacceptable. Although I'm certain that the TEN police officers involved will recall a different version of events, I suggest a boycott of The Sports Page (ALL of them, not just the one in Columbia) and a boycott of Columbia itself! I certainly won't spend a cent of my hard-earned money in Columbia.
